Sensa Terms of Use

1. About This Document

This is a legal agreement between you (the "User", "you") and Mikhail Gigolaev (the "Developer", "we", "us"), governing the use of the Sensa mobile application (the "Application", "Sensa").

By installing or using Sensa, you confirm that you have read, understood, and accepted these Terms. If you do not agree with any provision — please do not use the application.

These Terms are supplemented by the Sensa Privacy Policy, which is an integral part of this agreement.

2. What Sensa Is

Sensa is a mobile application for self-reflection, emotional journaling, and work with one's thoughts and states. The application provides:

• Structured journaling templates (CBT-based, body-thoughts-feelings, free-form entries)
• Mood tracking module (intensity, emotions, life areas)
• Coping cards (Thoughts, Situations, Self-support, Values)
• Breathing and mindfulness practices
• Attaching photos to entries — from your library or the camera
• Attaching a location to an entry — by map search or from your current position
• A voice-input helper that opens system dictation
• Reminders
• A profile picture and interface language selection
• Personal statistics

Photos attached to entries and your profile picture are stored on your device only and are not uploaded to the cloud. Details are in the Privacy Policy.

Sensa is developed with input from a practicing gestalt psychotherapist and draws on methodologies from cognitive behavioral therapy (CBT), acceptance and commitment therapy (ACT), schema therapy, and gestalt approach.

3. Sensa Is Not Medical Care

This section is critically important. Please read it carefully.

Sensa is a self-reflection tool, not a medical service and not a treatment.

The application does not:

• Diagnose psychiatric or psychological conditions
• Prescribe treatments, medications, or therapeutic interventions
• Replace work with a psychotherapist, psychiatrist, or other specialist
• Constitute an emergency service
• Provide medical supervision or state monitoring
• Guarantee any improvement in mental or emotional state

The content of the application, including the texts of practices, technique formulations, and any other materials, is provided for informational and educational purposes only. It does not constitute individual therapeutic advice.

If you are experiencing a crisis, have suicidal thoughts, are in acute emotional distress, or need professional help — please contact a qualified specialist (psychotherapist, psychiatrist, physician). In life-threatening situations, call the emergency services of your region.

Using Sensa does not eliminate the need for professional help where it is indicated.

4. Who Can Use Sensa

4.1 Age Restrictions

Sensa is intended for users 16 years of age or older. By using the application, you confirm that you are at least 16 years old.

If you are under 16, use of the application is only permitted with the consent and supervision of a parent or legal guardian who assumes responsibility for use. In this case, all obligations under these Terms are borne by the legal guardian.

4.2 Legal Capacity

By using Sensa, you confirm that you have the legal capacity to enter into this agreement under the laws of your country of residence.

4.3 Technical Requirements

To use Sensa, you need an Apple device with a current version of iOS, an internet connection (for data synchronization), and the application installed from the App Store.

5. Registration and Account

5.1 Access Methods

Sensa offers several ways to start using the application:

• Registration with email and password — creating a full account
• Sign in with Apple — login via Apple ID
• Anonymous mode — usage without creating an account (data is stored only on the device and in an anonymous record in our database)

5.2 Accurate Data

When registering, you agree to provide an accurate email address to which you have access. Email is used for login, password recovery, and important notifications.

5.3 Account Security

You are responsible for maintaining the confidentiality of your password and other credentials. Report any unauthorized access to your account to us as soon as possible at privacy.sensa@gigolaev.com.

We are not liable for damages arising from compromise of your credentials through your own fault (weak password, sharing your password with third parties, leakage from other services).

5.4 One User — One Account

Each account is intended for one individual user. Transfer of an account to third parties is not contemplated.

6. What You Are Permitted to Do

While using Sensa, you may:

• Create, edit, and delete your entries in the journal
• Attach photos and a location to entries, and remove them
• Create and work with coping cards
• Complete breathing and mindfulness practices
• View your statistics
• Adjust application settings to your preferences
• Delete your account at any time through the application settings
• Request an export of your data in a machine-readable format

Your entries are your intellectual property. We make no claim on the content you create in the application.

7. What Is Prohibited

When using Sensa, the following is prohibited:

• Using the application for illegal activities
• Attempting unauthorized access to other users' accounts or to the server infrastructure
• Decompiling, reverse-engineering, or disassembling the application, except as expressly permitted by law
• Using the application for automated data collection, parsing, or scraping
• Creating multiple accounts to circumvent restrictions
• Reselling, renting, or otherwise commercially distributing access to the application
• Using the application to distribute malicious software

Violation of these rules gives us the right to block your account without prior notice.

8. Intellectual Property

8.1 Developer's Rights

All rights to Sensa, including the source code, design, texts of practices, icons, graphics, logos, methodologies, and other elements of the application, belong to Mikhail Gigolaev or are used under license.

No part of the application may be copied, reproduced, published, transferred to third parties, or used for commercial purposes without the prior written consent of the Developer.

8.2 License to the User

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use Sensa on Apple devices that you own or control, exclusively for personal non-commercial use.

8.3 Your Content

The content you create in the application (journal entries, coping cards, notes) remains your property. We do not use it for training artificial intelligence models, for commercial purposes, or for transfer to third parties.

9. Cost and Payments

As of the effective date of these Terms, Sensa is provided free of charge.

Paid features or subscriptions may appear in the future. We will notify you in advance — through the application and/or by email — of any changes to the pricing model and give you the opportunity to make a decision before paid features take effect. Existing user data will not be blocked upon the introduction of a paid model.

If paid features are introduced, payment will be processed through standard Apple In-App Purchase mechanisms. App Store Terms of Use from Apple also apply to such payments.

10. Service Availability

We strive to ensure stable operation of the application but do not guarantee continuous availability.

Sensa depends on:

• Google Firebase infrastructure (data storage, authentication)
• Apple infrastructure (App Store, push notifications)
• Stability of the user's internet connection

We are not liable for temporary interruptions caused by circumstances beyond our reasonable control (force majeure, service provider outages, technical work by providers).

We reserve the right to perform scheduled maintenance, updates, and improvements that may temporarily limit access to the application. Where possible, we will provide advance notice of such work.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

11.1 The Application Is Provided "As Is"

Sensa is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement of third-party rights.

11.2 Limitation of Damages

We are not liable for:

• Any indirect, incidental, special, punitive, or consequential damages
• Loss of profits, loss of reputation, loss of data
• Damages arising from your use or inability to use the application
• Decisions you made based on information obtained in Sensa
• Any mental, emotional, or physical consequences of using the application

11.3 Emotional Sphere

Sensa works with a sensitive subject area — emotions and mental state. Using the application does not guarantee improvement in your condition. Reactions to the content of practices and journaling are individual.

If using the application causes you to feel worse, uncomfortable, or experience adverse reactions — discontinue use and contact a specialist.

11.4 Liability Cap

The Developer's total liability to you in connection with the use of Sensa, regardless of the cause and form of action, is limited to the amount you have actually paid for using the application during the last 12 months. If the application was provided free of charge, our liability is limited to the amount of 0 (zero).

This limitation applies to the maximum extent permitted by law and does not waive consumer rights granted by mandatory provisions of the laws of your country of residence.

12. Termination

12.1 Termination by You

You may discontinue use of Sensa at any time:

• By uninstalling the application from your device
• By deleting your account through the application settings (this will delete all your data per the procedures described in the Privacy Policy)

12.2 Termination by Us

We reserve the right to block or delete your account in the following cases:

• Violation of these Terms
• Use of the application for unlawful purposes
• Actions that threaten the security or functioning of the application
• Discontinuation of support or shutdown of the service

In the case of service shutdown, we will notify all users at least 30 days before discontinuation and provide an opportunity to export their data.

12.3 Effects of Termination

After termination (by either party), the license to use the application ends. Provisions of these Terms that by their nature should survive termination (intellectual property, limitation of liability, dispute resolution) continue to apply.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes:

• Through a notification or banner in the application
• By email, to the address provided at registration

The last update date is always shown at the beginning of this document. Continued use of the application after the Terms are updated means your acceptance of the new version.

If you do not agree with the changes — you may discontinue use of the application and delete your account.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Georgia, without giving effect to conflict-of-laws rules.

14.2 Jurisdiction

All disputes arising out of these Terms or in connection with the use of Sensa are subject to resolution in the courts at the location of the Developer — the city of Tbilisi, Georgia.

14.3 Consumer Rights in the EU

If you are a resident of the European Economic Area (EEA), these Terms do not limit your rights as a consumer guaranteed by mandatory provisions of the laws of your country of residence. In such case, you also have the right to bring an action in the courts of your place of residence.

14.4 Pre-Litigation Settlement

Before initiating legal proceedings, we ask you to attempt to resolve the dispute amicably by writing to us at privacy.sensa@gigolaev.com. We will do our best to respond and find a solution within 30 days.

15. Miscellaneous

15.1 Entire Agreement

These Terms together with the Privacy Policy constitute the entire agreement between you and the Developer regarding the use of Sensa.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, this does not affect the validity of the remaining provisions.

15.3 No Waiver

If we fail to exercise any right under these Terms, this does not constitute a waiver of such right.

15.4 Assignment

You may not transfer your rights and obligations under these Terms to third parties without our prior consent. We may transfer our rights and obligations to a successor in the case of reorganization or sale of business — with prior notice to users.

15.5 Apple Terms

Use of Sensa is also governed by the App Store Terms of Use of Apple. In case of conflicts between these Terms and Apple's terms for App Store distribution, Apple's terms shall prevail in the part relating to distribution of the application.

These Terms of Use are available in Russian, English and Georgian. All three versions are equally authentic. In case of any discrepancy between the versions, the version in the language in which you accessed the document prevails.
